Grieving Family Wins Legal Action Against Insurer Following Son’s Tragic Death

01 August 2017

The family of a man killed in Crete won a six-figure settlement following legal action when travel insurers refused to pay the money agreed in his policy.

Slater and Gordon LawyerKieran Mitchell is a senior associate specialising in travel and international litigation at Slater and Gordon Lawyers in London.

Settlement: £200,000.

What Happened: Our client’s son was assaulted whilst in Crete and died as a result of the injuries caused by his assailant. His travel insurer declined to provide the death benefit available under the policy, although failed to communicate that to the client, instead ignoring all correspondence.

Impact: The continued procrastination by the insurer prolonged and exacerbated the grief suffered by the family. They eventually settled nearly two years after their son died.

How Slater and Gordon Helped: We engaged in correspondence with the insurer with a view to exploring amicable settlement, but when they declined to respond we represented the family in court proceedings against the insurer, seeking an Order that the indemnity be paid. We have also represented the family at their son’s inquest and continue to represent them in the criminal proceedings in Crete against the assailant.

Decision: £200,000.
