A four-figure settlement was awarded to the victim of a road traffic collision, when another driver reversed into their vehicle in a car park and denied responsibility.

What Happened: Our client was driving through a car park when the defendant reversed from a space and collided with the offside of their vehicle.
Impact: Our client suffered severe pain and stiffness to his neck, which lasted three months. As a result of which, he was unable to work. The damage to his vehicle was also extensive, and required both doors on the driver’s side to be replaced.
How Slater and Gordon Helped: This should have been a straightforward case, however, the defendant disputed causation and attempted to vary standard directions to rely on a vehicle damage consistency report. This was opposed and the hearing was adjourned for our client to file further evidence. We obtained statements from our client and his two passengers. Following receipt of these statements, the defendant’s vehicle damage expert changed his opinion and confirmed that all damage to the vehicle was indeed caused by this accident.
The defendant’s solicitors continued, despite their own evidence being in our client’s favour. At trial the defendant alleged fundamental dishonesty against our client.
The judge held in favour of our client and no fundamental dishonesty was found.
Decision: A four-figure sum was awarded.
