Five-Figure Settlement For France Cycling Accident
27 January 2017
A British cyclist knocked from his bike in France was awarded a five-figure settlement following extensive injuries to his hip.
Slater and Gordon Lawyer: Kieran Mitchell is a senior associate specialising in travel and international litigation at Slater and Gordon lawyers in London.
What Happened: Our client was cycling in France when he approached a roundabout. He was struck by a third party vehicle attempting to overtake and knocked to the ground.
Impact: He suffered a fracture to his pelvis, requiring a total hip replacement. This prevented him from partaking in his favourite hobby of cycling. Following rehabilitation, he has now fortunately been able to return to it.
How Slater and Gordon Helped: We negotiated a settlement with the French insurers of the third party vehicle, and saw that the damages included the cost of further hip replacement in the future. French law applied in this case.
The defendant tried to argue that our client should only be compensated for the further hip replacement as and when the need arose, in the future. However, we didn’t want the client to be inconvenienced by having to bring a further claim and we persuaded the defendant otherwise.
Decision: £40,000 plus costs.
