Holidaymaker Compensated for Swimming Pool Cut in Spain

A holidaymaker received compensation for an accident at the Mallorca Rocks Hotel in Spain when she was injured, cutting her foot in the swimming pool.

What Happened: Our client went on holiday to Spain, staying at the Mallorca Rocks Hotel. She went into the pool and stood on something sharp and sustained a laceration-type injury to her foot. Our client held the hotel/tour operator to blame.

Impact: She needed stitches in her foot and regular medical attention for the rest of her holiday. She was not able to enjoy the rest of her holiday and it ruined the experience for her.

How Slater and Gordon Helped: We were instructed to act on a Conditional Fee Agreement (CFA) basis and liability was investigated. We pursued the matter as a package holiday claim against the defendant tour operator. Liability was vehemently disputed. We considered the defendant’s case to be weak and progressed the claim against them accordingly. Liability remained in dispute, but eventually they conceded and dealt with our client’s case on a without prejudice basis.

Decision: A settlement was reached out of court in the sum of £3,000 plus costs.
