£250,000 Damages After Car Passenger Suffers RTA Spinal Injuries

A woman who suffered spinal injuries when the car she was a passenger in pulled into the path of an oncoming car has received £250,000 in compensation.

What Happened: Our client was travelling as a front seat car passenger when the defendant, who was driving the vehicle, pulled out of a side road into the path of a correctly proceeding oncoming vehicle.

Impact: Our client sustained life-changing injuries including an unstable fracture to two of her lumbar vertebrae, requiring surgical fixation and stabilisation.

She also suffered facial injuries, a fractured thumb, soft-tissue injuries to her chest and abdomen and post-traumatic stress disorder.

How Slater and Gordon Helped: There were a number of causation issues raised by the defendant that made the case particularly challenging.

Liability was conceded but causation remained in dispute due to our client’s complex pre and post-accident medical history.

Court proceedings were issued and a joint settlement meeting was arranged but the defendant only offered £150,000.

The JSM was a classic case of the defendant attempting to find out how we were valuing the claim. The JSM failed to settle and the defendant left without knowing where we were pitching the value of the claim.

Decision: Two weeks after the JSM the defendant offered to settle the claim for £250,000 which was accepted.
