Five-figure settlement awarded to passenger involved in a road traffic accident in Spain that resulted in extensive injuries to her neck and arms.
Slater and Gordon Lawyer: Nicola Marshall is an associate personal injury lawyer at Slater and Gordon Lawyers in Manchester specialising in travel law.
What Happened: September 2012 in Spain, our client was on holiday with her friends. She was travelling in a vehicle driven by one of her friends who attempted to overtake another vehicle and in the process collided with it.
Impact: As a result of the accident, our client sustained multiple soft tissue injuries and required hospital treatment in Spain. In particular our client sustained injury to the neck, right hand, right side shoulder, left side shoulder, thoracic spine, lumbar spine and head and also psychological symptoms. Our client was later diagnosed with fibromyalgia as a result of the accident.
Her holiday was ruined, and she required medical treatment and rehabilitation.
How Slater and Gordon Helped: Acting for the client under a Conditional Fee Agreement Slater and Gordon (UK) LLP were instructed to pursue a claim against the Spanish insurer of the car that client was travelling in. The claim proceeded through the English court which was more convenient for our client.
Liability was admitted and we successfully negotiated settlement in our client’s favour after nearly three years.
Decision: The case settled for £15,000.
