Out of Court Settlement for Holiday Slip and Fall

12 February 2016

A holidaymaker staying at the Barcelo Thalasso Spa in Fuerteventura has received an out of court settlement following a slip and fall on hotel restaurant steps.

Slater and Gordon Lawyer: Darren Dyke is a personal injury lawyer at Slater and Gordon Lawyers in Manchester specialising in travel law.

Settlement Value: £3,474.57

What Happened: Our client was on holiday in Fuerteventura in August 2013. The holiday was booked with TUI UK Ltd and our client was staying at the Barcelo Thalasso Spa in Caleta de Fuste.

One day our client was walking from a second floor landing down a flight of steps leading to the hotel restaurant. She slipped on the top step, and fell down the flight of approximately six steps.

She suffered a soft tissue injury to her lower back which caused her pain and limitation in movement for a period of some three to four months.

How Slater and Gordon Helped: We brought a claim and arranged for medical examinations. The defendant admitted liability but failed to enter into settlement negotiations and, therefore, court proceedings had to be issued.

Shortly after service of proceedings, the defendant agreed to settle the claim.

Decision: An out-of-court settlement was achieved and our client was awarded £3,474.57 in compensation.
