Settlement Value: £125,000
Slater and Gordon Solicitor: Rachel Hall is a Personal Injury Solicitor at Slater and Gordon Lawyers in Derby.
What Happened: Our client, who was 57 years old at the time, was injured a head-on collision with another vehicle, a collision for which the other party admitted liability.
She sustained a head injury with underlying moderately severe brain injury with some post traumatic amnesia.
In addition, our client suffered a fracture of the left inferior orbital floor which required surgery and resulted in a sunken eye, some ongoing double vision and excessive watering of the eye. She also suffered damage to the orbital nerve, causing numbness to the left side of her face.
Impact: Our client had ongoing issues with balance which was expected to improve with specific treatment.
She also suffered a fractured sternum with difficulty breathing, soft tissue injuries to both thumbs, a small avulsion fracture to her right ankle and a laceration to her right Achilles tendon which required sutures.
Additionally, our client suffered psychological damage, diagnosed as an adjustment disorder, and required therapy.
Our client was also diagnosed as having an increased risk of developing post traumatic epilepsy, but had not suffered any symptoms since the accident and the risk would decrease to that of the normal population with time from the accident.
She made a good recovery and was able to return to her pre-accident employment within four months.
How Slater and Gordon Helped:
We obtained complex medical evidence and reports from a number of different specialists and sourced funding for our client’s treatment and the investigations into the collision.
A claim for provisional damages was made but compensation was agreed on a full and final basis, taking into account the increased risk of future epilepsy.
Decision: The claim was settled on behalf of our client who received £125,000 compensation.
