Compensation for Accident Abroad Claim Missed due to Professional Negligence by Other Law Firm
17 June 2015
Slater and Gordon Travel Litigation specialist Paul McClorry acted for a client who was let down by her original firm of solicitors after an accident on holiday.
Slater and Gordon Solicitor: Paul McClorry is the National Practice Development Leader for Travel Law at Slater and Gordon Lawyers UK.
Paul's client, Miss W, was injured in a road traffic accident whilst on holiday in Spain.
She was walking along a pavement when she was struck by a motorcyclist travelling the wrong way down a one way street.
Miss W sustained serious orthopaedic injuries as a result. She had medical treatment in Spain and also upon her return home to England.
Miss W originally instructed another firm of solicitors in England but they failed to investigate her case properly. They did not investigate suitable funding for her case, and did not consider the applicable law issues that are important when an accident takes place abroad.
Impact: As a result of their negligence, the solicitors originally instructed by Miss W missed the one year Spanish time limit for bringing a claim. Miss W was prevented from bringing a claim against the motorcyclist's Spanish insurance company as a result.
How Paul helped: Paul successfully negotiated a five-figure settlement against Miss W's former solicitors, representing the lost chance to pursue her case.
Decision: five-figure compensation settlement awarded.
