Slater and Gordon Personal Injury Solicitor Nigel Smith secured £1 million compensation for a labourer who suffered a paralysed arm in an accident at work.
Nigel’s client was a part-time labourer for a skip hire company in Smethwick. In April 2011 whilst attempting to lubricate the flanges of a rotating recycling drum Nigel’s client caught his right arm in the machinery, ripping the nerves supplying his right arm from the spinal cord and causing him to sustain a severe brachial plexus injury.
The accident at work left Nigel’s client with a right arm that was almost wholly paralysed.
The skip hire company defended liability arguing that Nigel’s client had not been trained to use the machinery that caused his injuries and had taken it upon himself to operate the equipment when the company had requested him to ask a trained colleague to do so.
Proceedings started after an initial neurology expert report was obtained. In 2014 the employers accepted 80% liability and Nigel secured further reports from medical experts.
Nigel’s client’s work accident compensation claim was established on the basis that he was unlikely to return to fully-paid work and that, had he not been injured, had every prospect of securing permanent work in the future.
Ten days before a liability trial was due to start, Nigel secured a £1 million settlement for his client on a full liability basis with discount for contributory fault.
The settlement means Nigel’s client can continue with his physiotherapy and cognitive behavioural therapy and can get the additional transportation support he requires due to his injuries. Should Nigel’s client’s condition deteriorate he would have the right to take the case back to Court for review.
