Slater and Gordon Family Solicitor Hannah Cornish successfully represented a father who was encountering significant difficulties spending time with his young daughter.
The father was seeing his daughter for 50% of the time and the mother submitted an application to the court requesting his time was significantly reduced and requesting the court's permission to relocate some 50 miles away and change the child's school. This would mean the father would only see his daughter on alternate weekends.
An independent body considered the mother's application and agreed that father's time should be reduced but did not agree with mother's relocation. The mother, with the support of the independent body, pursued her application to reduce father’s time with their daughter and for their daughter to predominately reside with her.
The matter proceeded to a final hearing where all parties gave evidence. The Judge did not accept it was in the child's best interests to have such a significant reduction in when she saw her father. It was ordered that the father's time with his daughter should not be reduced.
It’s unusual for the court to go against the recommendation of an independent body but in this case we were able to show that there were a number of issues which were yet to be properly explored and we successfully convinced the court to go against the recommendation.
