Accident in a Public Place Led to Head Injury Claim

Tracey Benson represented a lady who sustained a head injury in 2009 when she walked into a disused metal pipe hanging from the ceiling in the underground car park at her block of flats.
She was not previously aware of the existence of the pipe. She was momentarily knocked unconscious and sustained a nasty wound to the top of her head. Thereafter she developed post concussion syndrome together with PTSD. She dealt with the claim as a litigant in person directly with the Zurich insurers who obtained a Neuropsychological report and made her an offer to settle of £2,500.00.

High Court Proceedings were commenced and medico legal evidence was obtained from a Neuropsychiatrist and 20 sessions of urgent CBT were arranged for her.
At the time of the accident she was attempting to set up her own business as a marketing executive. She was unable to do this post accident. She returned to work employed in digital marketing but was only able to work 4 days a week. The prognosis remained uncertain due to the ongoing post traumatic stress disorder meaning she was unable to sustain relationships and remained depressed and sleeping excessively.
The Defendants put extensive questions to Tracey's clients expert and disputed the claim on the grounds of an extensive past history of ill health.
The Head Injury Compensation Claim was settled out of Court for £80,000.00. £77,500.00 more than the sum Zurich offered her as a litigant in person.
