Protective Trust Arranged for Child who Suffered Brain Injury at Birth

Our client suffered a brain injury at birth following complications which led to him being starved of oxygen. Despite still being in his early years, it's clear that our client will suffer from his brain injuries for the rest of his life.  

His parents approached Slater and Gordon Lawyers for assistance in making a brain injury claim on their son’s behalf for the injuries sustained and also for the lifetime management of the award he would ultimately receive.

It was anticipated that the litigation process would take up to 10 years. In that period, however, it was important that our Personal Injury Solicitors and Inheritance & Welfare Solicitors worked in unison to ensure that our client’s quality of life and rehabilitation was maximised, to give him the best hope of improvement and recovery.

Slater and Gordon’s Personal Injury Solicitors successfully obtained an initial compensation payment from the Defendant in the matter and our Inheritance & Welfare Solicitors arranged for the creation of a Protective Trust.

The Protective Trust structure was flexible to allow our client’s parents to arrange appropriate treatment and housing to ensure that their son had the opportunity to benefit from quality care. The Trust structure enabled them to meet his requirements quickly and effectively.

Our Inheritance & Welfare team worked alongside our Personal Injury team to persuade the Court to release funds into the newly created Trust.

The Inheritance & Welfare team then ensured that our extensive contacts created a robust and protective network of support around our client and his family, to ensure that funds were properly invested, managed and applied.
