Child Accident in Play Area Leads to Successful Infant Settlement

On the day of the accident our client was playing within the structure of the play area, supervised by her mother. Our client started to play with a toy car and then suddenly our client’s mother heard her crying and saw that the toy car had toppled over with our client trapped inside.
Our client sustained personal injuries including a lost tooth, banged head, lip and chin injury and as a result of the accident felt self-conscious and she has not been willing to take part in usual activities and did not want to mix with other children.
Since the accident, our client’s mother has attended the premises and taken photographs of the toy car and spoke to staff members who confirmed the toy car had been removed from use and was in the skip waiting to be taken away. The toy car was defective, its wheels and axles were in a poor state of repair. This was confirmed by the staff members.
An accident book entry was completed and liability was admitted with a £3,376 infant settlement approved by Court.
