Mothers removal of Child from UK to Australia

We represented a mother wanting to remove her 9 year old child from the UK to Australia. The parents were separated and the father had Parental Responsibility.

The child lives with the mother.

The father strongly opposed the application and applied for a Residence Order as he wanted the child to live with him, although he had irregular contact with the child since separation.

We successfully argued that the mother’s application was genuine and was not motivated by some selfish desire to exclude the father from the child’s life and that the impact of refusing the removal out of the country would be detrimental to her and the child.

We agreed direct and indirect contact between the child and his father.
