Husband unwilling to disclose his finances

We recently acted for a wife in divorce proceedings and were also instructed to deal with financial matters. The wife was a member of the NHS and the husband was a self employed Property Developer. The husband would not give voluntary disclosure of his financial means, nor would he attend mediation. We therefore issued proceedings in court so that a judge could decide the case.

Following the first hearing, we finally obtained the husband’s full disclosure by way of financial statement (Form E); we were therefore able to advise the wife regarding proposals for settlement. There were substantial assets, including two properties, investments and pensions. The case successfully settled at the second hearing. Our client retained the former matrimonial home. Child maintenance and spousal maintenance was agreed and a lump sum paid to our client to reflect the distribution of the other assets.
