Negligent misstatement about nurse leads to defamation claim

01 September 2010

A nurse was the unfortunate victim of a negligent misstatement resulting in a defamation claim against a local newspaper. The newspaper’s article reported on an investigation by the Nursing & Midwifery Council (NMC) about a nurse who had allegedly refused a dying patient medication, and Ms Mwansa was named as the nurse responsible. In fact, the wrong nurse had been reported to the NMC and Ms Mwansa had not been involved. A successful settlement was negotiated, which included payment of damages and her legal costs, together with a published apology, a copy of which was to be provided to the patient’s widower.
