Client Injured at Work Due to Health & Safety Issue

Our client was a trainee physiotherapist working under the instruction of her senior when she suffered an injury at work whilst performing a 3 point stand technique in order to lift a large/heavy patient.

Liability and causation were robustly denied by the NHS Trust. The Trust argued that not only had the claimant received all the appropriate training but that the task was perfectly safe and did not breach the Manual Handling Operation Regulations.

Proceedings were issued and served upon the Trust. Despite maintaining a denial of liability, compensation for this health and safety error was reached in our client’s favour in the sum of £7,500.
