Employment Lawyers Achieves Substantial Compensation in Unfair Dismissal Case

In this unfair dismissal case our client 'the Claimant' had been dismissed by his employer by reason of alleged gross misconduct following and incident where the Claimant had been sitting in his car at work and sounded his horn to prevent the Complainant (a work colleague) from reversing into him.
The Claimant has been accused of racist verbal abuse which the Complainant said he had been subjected to through what he had been able to lip read through the Claimant’s wing mirror.
At the hearing the Employment Judge upheld the Claimant’s claim for unfair dismissal.
The decision was based on the fact that the Respondent had not carried out a sufficient investigation. The Employment Tribunal found the failure to investigate fairly resulted in a flawed decision, and so an unfair dismissal declaration was obtained and the Claimant was awarded significant compensation.
