Shohaab Dar gains victory for senior civil servant over equal pay dispute

Russell Jones & Walker's Shohaab Dar acted for a senior civil servant in a Government department. She discovered that she was earning less than her male predecessor and a number of other key people whom she cited as comparators. She had more experience and better qualifications than all her comparators. The employer argued that the difference was explained by length of service, experience, and performance. The claim was stayed pending the European Court of Justice decision in Cadman, a high profile equal pay case in which RJW acted for the Claimant on the important question of whether the use of length of service pay increments is lawful. Following the decision in Cadman a favourable settlement was reached.
