Road Traffic Act case acquitted

We represented a client arrested for being unfit through Drink or Drugs under the Road Traffic Act. Our clients vehicle had been involved in a collision outside his home address, causing damage to his vehicle and to a road sign – there was a passer-by witness. Police had attended, forced entry and found our client asleep. He instructed that he had not had a drink prior to the collision which had come about through an error caused by tiredness. He had then consumed a large Jack Daniels after arriving home. He was advised to provide a specimen for "count back" and to give his account in interview. He was bailed but the final decision was to take no further action.
