Road Traffic Accident changes man's behaviour

Head injured individuals commonly require access to sexual services following an accident yet this is often ignored by their personal injury solicitor. Kimberley Owen, one of our London partners, recently represented a man who was discovered to be utilising the services of prostitutes and sex chat lines on a regular basis following a road traffic accident. He had not availed himself of these services before the accident but following his accident he considered himself to be so unattractive to the opposite sex that he felt he had no alternative available to him. He demonstrated that he did not understand the risks associated with using a prostitute or the need to use a condom. As a result of this man's change in personality and behavioural problems it was deemed unlikely that he would ever develop or sustain a relationship with a woman and was therefore unable to enjoy a regular sexual relationship. Expert evidence was obtained which recommended that access to sexual services should continue and that it would be preferable for a prostitute to visit the man at his home. Evidence was also obtained regarding the cost of the services and the number of years for which he would continue to require these service to enable a claim to be formulated on his behalf.
