We are committed to road safety and work closely with road safety charities. Sadly, there is a lot more work to do, and road traffic collisions remain a major cause of injury and death.
We act regularly for drivers and passengers who have sustained injuries, from minor to catastrophic, in accidents while on the road in numerous countries around the world.
How Does it Work?
If you have been involved in an accident while travelling on board a vehicle or motorcycle, or as a pedestrian or cyclist abroad, we are here to help.
As a result of developments in EU law, we are increasingly able to pursue European road traffic accident claims here before the English Courts.
You will speak to one of our specialist team from day one. They will consider with you in detail the question of where and against whom the claim should be pursued. Often, in road traffic accident abroad claims, there can be conflicts of jurisdiction or conflicts of law and we will be open with our advice from the very first call to ensure that we are acting in your best interests.
Many European countries have laws where fault does not need to be proved in cases involving passengers, pedestrians, cyclists and motorcyclists. It is therefore important to obtain advice from a local lawyer early in the case, and we work with a network of lawyers around Europe and the rest of the world who can provide us with that advice at an early stage so that you know, as early as possible, what to expect.
Slater and Gordon Travel and International Litigation Lawyer Joanne Berry recently secured a seven-figure settlement in compensation on behalf of a victim who suffered 96% burns to her body as a result of an overseas road traffic accident.
Be aware that strict time limits apply when making personal injury claims. Time limits vary depending on a number of circumstances.
Claims for road traffic accidents will, more often than not, be subject to the law of the country where the accident occurred. In some EU jurisdictions, the time limit can be as little as one year.
Do not put it off, consult with one of our expert lawyers immediately. They will provide you with advice to put your mind at ease.
If you are involved in a road traffic accident abroad and if you are able, take the following steps to help us help you:
- Complete an ‘Agreed Statement of Facts (constat amiable) with the driver of the other vehicle and make sure it includes their insurance details and vehicle registration number;
- Obtain contact details and reference number of any attending police;
- Take photographs of the accident location and any vehicle damage;
- Take the names and addresses of any witnesses to your accident and ask them to confirm that they would be happy for us to contact them if necessary.
