Fatal accident to lead to compensation claim?
The family of a man who died in a fatal accident at work could decide to launch a compensation claim on behalf of their loved one.
Joseph Murphy passed away at the age of 31 in August 2009 when he fell from scaffolding while working for Apex Scaffolding at a construction site in St Leonards on Sea, East Sussex.
At the time of this incident, Mr Murphy was carrying out a project to build an over-roof made of scaffolding and while the exact distance he fell remains unclear, an investigation by the Health and Safety Executive found several safety faults in his working area.
For instance, the body established there were several missing handrails on the surface - along with incomplete platforms - and also found Apex oversaw a negligent safety culture.
Consequently, the company, its director Michael Walsh and supervisor of the site in question Leslie Hustwayte were all prosecuted.
