The Media Hype Surrounding Whiplash Claims

It seems not a month goes by without reading an article in the press criticising people who make whiplash compensation claims, much to the frustration of genuine claimants whose whiplash injuries have a significant impact on their life.

Headlines such as “Backlash against Whiplash” and “UK: The Whiplash Capital of Europe” will always sell newspapers, but they hide the truth that most whiplash claims are genuine. In fact, just 7% of whiplash claims are thought to be fraudulent, according to Labour MP Andy Slaughter.

Isn’t it time we stood up to the media hype surrounding whiplash and stood up for the many people whose lives are affected by whiplash injuries?

Quashing the Whiplash Myth

The general argument put forward by the media is that “bogus” whiplash claims cost the insurance industry billions of pounds a year, which forces them to pass the burden on in the form of higher motor insurance premiums.

People reading these articles would be forgiven for thinking that the UK is currently experiencing some sort of ‘explosion’ in whiplash claims. However, a response to a Freedom of Information request to the Department for Work and Pensions’ Compensation Recovery Unit revealed that the number of whiplash claims in the UK have steadily fallen since 2008.

A recent open letter to the insurance industry by the Association of Personal Injury Lawyers called for “less obfuscation about whiplash claims” and reminded them that we all have vulnerable injured people to help.

The letter also made clear how important it is for people to seek the advice of a properly qualified and accredited solicitor when making a whiplash claim.

Making a Whiplash Compensation Claim

Whiplash symptoms often don’t appear immediately, so following guidance on treating whiplash is essential.

Some people are unfortunate enough to suffer chronic whiplash, the symptoms of which can last for many months – something which is often overlooked by the misleading media articles about whiplash.

As long as you have been injured and can provide medical evidence, you are entitled to claim compensation for your whiplash injuries.

The expert road traffic accident solicitors at Slater and Gordon can advise you on all aspects of your whiplash claim. In cases where the whiplash symptoms are less severe, our whiplash solicitors can fast track your claim, meaning you receive compensation as soon as possible, something that can be vital in paying for essential medical treatment.
