New UK Asbestos Compensation Rules
New compensation rules brought in recently mean people suffering with asbestos-related cancers such as mesothelioma are to receive up to £54,000 extra.
From now on, compensation paid through the Diffuse Mesothelioma Payment Scheme, will rise to match 100% of average civil claims, up from the current 80%.
The UK Government’s Diffuse Mesothelioma Payment Scheme compensates sufferers with a one-off lump sum compensation payment, subject to the age of the individual. The older a person is at diagnosis, the smaller the lump sum.
Costs for the scheme, which has already paid out more than £19m in its first 10 months, are met by a levy on the insurance industry. From yesterday, people diagnosed with mesothelioma will benefit from the payment increases.
Mesothelioma is a terminal cancer of the lining of the lungs caused by exposure to asbestos. Asbestos diseases can typically take up to 40 years to appear in the body and life expectancy from diagnosis is as little as eight to nine months.
Most mesothelioma compensation claim sufferers can claim damages through their employer’s liability insurance, although a significant minority cannot due to the time it can take for the disease to appear and resulting problems tracing previous employers and insurance providers.
Hundreds of mesothelioma sufferers unable to claim compensation due to problems locating their previous employer or employer’s liability insurer, have already been helped by the scheme.
The UK Government should have introduced 100% compensation back in July. It’s unfortunate that only from yesterday have mesothelioma sufferers had full entitlement to payments that match those of average civil claims.
We would now like to see the government introduce a levy on insurance companies to fund medical research into this truly terrible disease.
