Why Cheryl Cole Should Consider a Pre-Nuptial Agreement

It’s reported that Cheryl Cole is so loved up with new man Jean-Bernard, who is believed to be from a wealthy French family, that she decided not to sign a Pre-Nuptial Agreement, which would protect her £16million fortune.

This seems surprising given that its Cheryl’s second marriage, one would hope that her team would be advising her to protect her wealth.

Pre-Nuptial Agreement is entered into before marriage and allows a couple to plan financially should their marriage breakdown. Perhaps Cheryl felt that a Pre-Nuptial Agreement is unromantic and dooming the marriage to failure.

In reality however marriages do breakdown and having a Pre-Nuptial Agreement in place can avoid the time, expense and animosity that is experienced in many divorce cases. The Court will consider whether the parties have taken independent legal advice, whether they have exchanged full information regarding the financial assets and whether the agreement was entered into at least 21 days prior to the ceremony.
