Matthew Smith Senior Associate, Medical Negligence
Matthew is a senior associate and head of the catastrophic medical negligence team at Slater and Gordon in London.
He is a member of APIL and has over 12 years' post-qualification litigation experience advising clients on very complex claims, usually of very high value and of utmost severity. He particularly is involved with obstetric cases, mainly those involving hypoxic brain injury sustained shortly before or at the point of birth, but he undertakes the full remit of medical negligence matters including those involving mental health injury resulting in suicide and other damage, delays in diagnosis and misdiagnosis of oncological issues especially and the full range of surgical errors. He brings claims against both the NHS and private clinicians.
Within his current caseload are multiple cases worth in excess of a million pounds, the majority of which involve delay in delivery resulting in hypoxic brain injury and developmental delay to the delivered child.
Very recent examples of Matthew’s settled cases include £1million for a delay in diagnosis of melanoma leading to significant lymphodema, a matter settled via a joint settlement meeting in the sum of £250,000 for a client who suffered foot drop and ongoing disability caused as a result of the negligent injuring of the client’s sciatic nerve during hip replacement surgery, and £40,000 for the negligent repair of a straightforward bilateral hernia, leading to a temporary bowel injury which had to be surgically corrected.
