Pension disputes: What are they and how can we help

A pension is a fund whereby amounts are paid regularly during your working life to support your retirement from work. As your pension will be your primary source of income, it is vital you understand your rights while you’re building it up.

What are pension disputes?

Pension disputes are issues arising from pension schemes and will often involve employers, trustees, pension professionals, members, insurers and industry bodies.

There are many different types of pension disputes, such as:

  • Pension law issues relating to the main public sector pension schemes: LGPS, the NHS Pension Scheme, TPS, the Civil Service Pension schemes, USS & Police Pension schemes.
  • Pension disputes relating to the administration of public and private sector pension schemes, through complaints under the Internal Dispute Resolution Procedure (IDRP) and to the Pensions Ombudsman.
  • Pension disputes concerning the interpretation of pension scheme rules.
  • Pension law issues relating to changes to private sector pension schemes that are averse to the interests of employees/scheme members, for example relating to contribution levels, rates of increases.
  • Employers' and pension scheme administrators' negligent advice, failure to advise employees or pension scheme members about pension rights and benefits and/or changes to the same.
  • Pension disputes and appeals concerning access to ill-health retirement benefits.
  • Pension disputes concerning overpayments.
  • Challenging rules and provisions in pension schemes which are discriminatory and or in breach of Human Rights legislation.
  • Pensions Group Litigation and dispute resolution.

Pension schemes are quite rightly protected by stringent legislation to ensure that your rights and benefits are being looked after. However, in a constantly shifting landscape, changes may be made to your scheme that are detrimental to your final pension, and mistakes may also be frequently made.
