Constructive dismissal

Most of us appreciate that a dismissal has taken place when an employer terminates an employees contract. However, a resignation will also be treated as a dismissal if an employee is forced into resigning by the employer’s fundamental breach of contract. This is what is known as ‘constructive dismissal’ and you may be able to bring a claim for unfair dismissal because of it.
