Swimmer Recovers £27,000 for Swimming Pool Slip
26 August 2015
A swimmer received substantial compensation after she broke her ankle after slipping on a pool of water.
Slater and Gordon Solicitor: John Reeder is a Personal Injury Solicitor at Slater and Gordon Lawyers in London.
Settlement Value: £27,000
What happened: Our client had enjoyed a swim at her local leisure centre. At the time, the leisure centre changing rooms were not in operation so swimmers were instead being directed to changing rooms at the school next door.
The school changing rooms were accessed via a corridor. Whilst walking along the corridor, our client slipped on a pool of water that had been left untended on the floor due to other swimmers having used the walkway previously. She suffered a significant ankle fracture.
How Slater and Gordon helped: Rather than relying upon the NHS, Slater and Gordon instructed an orthotics expert to examine the lady.
On the basis of the expert’s report, we were able to recover an additional £10,000 to pay for orthotic and related treatment.
The defendant also insisted on arguing that our client should not be awarded the private costs of having metalwork in her ankle removed. Slater and Gordon persuaded them that they were wrong about this and the client was awarded a further £2,500 to enable her to have this treatment.
Impact: The client recovered well from her injury but was left with pain that was only eased by the use of foot orthotics for both shoes – provided by her local hospital. She will require these for the rest of her life.
Decision: One of the key issues for our client was that the NHS orthotics could not be used with sandals. She enjoyed wearing sandals but had not worn them since the accident.
Fortunately for our client, the compensation she has now secured will allow her to buy the specialist orthotics she will need to allow her to wear them with sandals.
