Cruise Ship Accident Claim Settled
19 February 2015
Slater and Gordon Travel Litigation Lawyer Joanne Berry secured compensation for the widower of Mrs Richardson, who died following an accident on a cruise off the coast of Norway.
During early Spring 2011 Mr and Mrs Richardson embarked on a Norwegian Lights cruise in Scandinavia booked via an English tour operator.
Unfortunately during the cruise Mrs Richardson fell ill. She saw the ship’s Doctor who advised she needed to be treated at an on land hospital. The local lifeboat was summonsed and an attempt was made to transport Mrs Richardson onto the lifeboat, to take her to a Norwegian hospital.
During the course of the manoeuvre the unthinkable happened, and Mrs Richardson was dropped into the Ocean. She was in the water for some minutes before being rescued, she then required resuscitation and was taken to a local Norwegian Hospital where she remained before being repatriated home to a local hospital in the UK, where she sadly later died.
Mr Richardson instructed Slater and Gordon Lawyers to investigate the cause of the accident. An inquest took place in Carlisle during 2013, at which we provided representation.
Despite the facts the cruise company refused to accept responsibility. It was necessary for us to commence Court proceedings to pursue the matter, and the cruise company sought to attribute any blame to the Norwegian rescue company, who then were added to the claim. The Norwegian cruise company denied that their actions were in any way at fault.
Accident at Sea Claim litigation followed and negotiations then reached a settlement in February 2015 which provided for the cruise company and lifeboat company to share the blame.
Joanne Berry commented that she was delighted that Mr Richardson’s tenacity in seeking justice had been finally rewarded by a negotiated outcome.
