Our client was put at risk of redundancy but we successfully argued that their role was not redundant which resulted in the employer agreeing that the employee would remain in employment and continue receiving Permanent Health Insurance benefits. Ultimately, our client negotiated a favourable settlement of potential claims against the employer and the PHI provider - jointly about which we advised.
