Experienced officer accused of aiding and abetting actual bodily harm

19 November 2009

RJW represented an experienced officer who had been accused of aiding and abetting actual bodily harm by the custody sergeant and then failing to report the incident. The offence was alleged to have taken place against a drunk and abusive detainee in the custody suite of a busy police station. In addition to our knowledge of the Conflict Management Model, we studied the witness statements and CCTV in detail and made submissions to the Judge that there was no case for our client to answer. Our submissions were successful and the case was discontinued against our client.
