An ex-manager at a bistro in a Birmingham hotel is claiming he was the victim of constructive dismissal and racial discrimination.
Polish national Mieczyslaw Ratayczyk worked at the Hotel Du Vin - which has operations in a number of cities, including Bristol and Cambridge - and says he was hit in the face by a customer who was angry he had to wait for his meal.
The former worker suggests that he was subsequently suspended from his role, while the customer was given a free meal.
Mr Ratayczyk alleges that his treatment after the assault - which occurred in April last year - forced him to quit.
A statement made by him that was read out during an ongoing tribunal said: "Having suffered deep humiliation and distress I was extremely upset that I was suspended."
The feeling of betrayal was further compounded by the decision by the hotel to offer the customer complimentary food and wine, he added.
