The High Court have ruled that the family of a six year old boy who suffered brain damage during birth could be awarded £10 million compensation.
During the boy's birth the doctors damaged his skull whilst trying to free his head from his mother's pelvis during a Caesarean section at Homerton University Hospital. It was found by the court that the midwife assisting the birth used an inappropriate manoeuvre, forcibly rotating the baby's head.
The birth of a child should be a happy and joyous event, but sadly medical errors during labour and delivery can lead to the child suffering serious brain injuries and other injuries.
At Slater and Gordon Lawyers our Medical Negligence Solicitors have successfully represented numerous clients with their birth injury claims; these are parents who have sustained birth injuries to their babies such as Cerebral Palsy, fractured skulls and Erb's Palsy. We also represent parents who have suffered the stillbirth of a child as a result of hospital negligence during labour.
The amount of medical negligence compensation that the family in this case may be awarded seems high. However, the cost of rehabilitation including care, treatment and support for a disabled child is extensive. The cost of care alone can amount to £200,000 per year, for the rest of the child's life.
On top of that adaptations are usually required to the family home to enable the child to live there comfortably. Again these adaptations are very costly. The benefit of pursuing a Medical Negligence Claim is that it can help provide for the care, support, aids and equipment that the injured child needs to make their lives more comfortable and help to provide them with some independence.
Slater and Gordon Lawyers offer a free consultation for people injured by medical mistakes, and 98% of the claims we deal with are funded through a No Win No Fee agreement.
