Slater and Gordon Lawyers: David Roberts is a senior associate specialising in personal injury claims at Slater and Gordon Lawyers in Manchester.
Emily Kalwak is a personal injury solicitor at Slater and Gordon Lawyers in Manchester.
What Happened: Our client worked in cereal manufacturing and whilst on duty she slipped and fell onto a hard concrete floor. The floor was in an unkempt state with an excess of cereal product creating a hazard and danger to all employees.
Impact: Our client sustained injuries to both her lower spine and coccyx as a result of the accident. She needed significant orthopaedic treatments including physiotherapy and injection therapy as well as several operations on her spine, culminating in the removal of her coccyx. She has been left with permanent spinal pain.
In addition to the physical problems, our client sustained psychological injuries which required therapy. She was also left unable to work in her previous role in the factory.
How Slater and Gordon Helped: The employer was negligent and in breach of their duty of care to our client. We pursued a claim and an early admission of liability was secured from the defendant. We then obtained detailed medical evidence to support the claim, as well as the future medical picture, from very experienced consultants. Repeat examinations were arranged to ensure all medical issues and difficulties were explored.
Decision: We advised an initial offer of £51,000 was unreasonable and continued negotiations, with our client eventually accepting £100,000.
