Six-Figure Settlement For France Motorbike Death
07 December 2016
A six-figure settlement was awarded to the family of a holidaymaker who was tragically killed in a motorcycle road traffic accident in France.
Slater and Gordon Lawyer: Nicola Rostron is an associate, specialising in travel litigation at Slater and Gordon Lawyers in Manchester.
Settlement: Six-figure settlement.
What Happened: Our clients’ father was on a motorbike in France when, in a momentary lapse of concentration, an elderly driver collided head on with him.
Impact: The emergency services attended, and he was airlifted to a local hospital but tragically all attempts to save him failed.
A French criminal hearing was held, and the driver was charged with manslaughter whilst driving their vehicle without due care and attention, given a suspended prison sentence for one year and fined 1,000 Euros.
How Slater and Gordon Helped: We liaised with the British Consular and obtained a copy of the French police report and hospital records.
We pursued a civil claim on behalf of our clients against the third party French insurer through the English Court. This was a particularly complex case as French law applied to the claims. It was therefore necessary to instruct a French law expert when all expert evidence had been collated.
Decision: The claims settled by way of a joint settlement meeting for a significant six-figure sum.
