A holidaymaker was awarded a five-figure settlement for damages when she slipped and fell in a Majorca hotel, resulting in permanent injuries.
Slater and Gordon Lawyer: Nicholas Lukacs is a litigation executive in Slater and Gordon's travel law team in Manchester.
What Happened: Our client booked a package holiday to the Barcelo Ponent Playa Cala D’or in Majorca in August 2012. She was walking back to her room through the reception area of the hotel when she slipped on the highly polished floor.
Impact: As a consequence of the accident, our client broke her right arm; her humerus was broken in two places. She was admitted to hospital in Palma where she had an operation to pin her arm together. She then had a further operation in March 2013 as one of the fractures had not repaired. Our client has been left with scarring to her right arm and has residual shoulder stiffness. It is the medical expert’s opinion that this is likely to be permanent.
How Slater and Gordon Helped: Slater and Gordon took on the case on a no-win no fee basis and sent a letter of claim to the defendant, who denied responsibility. Our client was medically examined, whilst Slater and Gordon adduced favourable expert evidence from a local standards expert and then from a jointly instructed Spanish Lawyer.
Decision: The case settled for £30,000.
