Holidaymaker Injured on Wet Floor at Holiday Resort in Mexico

A five-figure settlement was awarded following a slip and fall in a holiday resort toilet in Mexico.

What Happened: The claim arises out of an accident that occurred on 4th May 2012, the first full day of an 11-night package holiday to the Sensatori Resort in Mexico, organised and supplied by the tour operator Thomson Holidays. As our client was walking out of a set of toilets at the hotel he slipped on a wet floor, on which water had accumulated due to a blocked drain.

Impact: Our client suffered a minimally displaced fracture of the distal radius with a small central TFCC tear.

He is left with what appears to be permanent pain and a loss of movement and grip strength, with his role as his severely disabled daughter’s carer being impeded due to the injury.

How Slater and Gordon Helped: Slater and Gordon helped pursue a successful claim for compensation by claiming there had been a breach of Mexican standards and regulations, and that the hotel had failed to exercise the reasonable care.

The defendant, after initially admitting liability, then tried to resile from that admission. However, a few days prior to the application hearing, which we were opposing, they agreed to settle the claim.

Decision: The claim was settled in favour of our client and £30,000 compensation was agreed.
