19 November 2015
Two cousins have received compensation in a road traffic accident claim after sustaining injuries following a collision.
Slater and Gordon Fee Earner: Rob Jones is a Personal Injury Lawyer at Slater and Gordon in Derby
Settlement Value: £4,207 and £4,590
What Happened: Our clients were cousins and were driving in their works van one day when they stopped at a rail crossing.
The car driver behind them failed to stop in time and collided with their van, causing the two cousins to sustain injuries.
How Slater and Gordon Helped: The defendant driver admitted the collision but alleged that, it was a low velocity impact, no injuries could have been caused.
The defendant also alleged that our client deliberately slammed on his brakes for no reason and that only one of the two cousins were in the van at the time of the collision. The court found that the defendant was mistaken on both counts.
We proceeded to trial and bettered the initial Part 36 offer, with the court awarding enhanced interest on both damages and costs.
Decision: The claim was settled in favour of our clients, who received £4,207 and £4,590 respectively.
