Settlement for Family of Former Cammell Laird Shipbuilder
08 June 2015
Slater and Gordon Solicitor Louise Larkin was instructed by the family of a former Cammell Laird Shipbuilders employee who had suffered from asbestosis.
Slater and Gordon Solicitor:
Louise Larkin is a Litigation Executive in the Chest & Asbestos Group at Slater and Gordon Lawyers in Liverpool.
Mr R had worked for Cammell Laird Shipbuilders and was exposed to significant quantities of asbestos dust and fibres.
We were instructed by the daughter of the late Mr R who had suffered asbestosis during his lifetime. He had previously consulted a local solicitor who advised that he would not be able to claim for compensation as there was no evidence that he was suffering from asbestosis.
Mr R sadly died in October, 2012. It came to light following his death that asbestos exposure may have contributed towards his death.
How Louise helped:
Louise was instructed by Mr R’s daughter and subsequently investigated a claim and witness statements were obtained from his former colleagues. Proceedings were about to begin in the Royal Courts of Justice in London. Following extensive correspondence and negotiations, the insurers of Cammell Lairds admitted liability and agreed to pay damages.
An offer was made to pay compensation, which was subsequently accepted by the family. Given the fact that the claim was unsuccessful first time around, it shows that sometimes a second opinion should be sought be expert specialists in this field. His daughter was very pleased with the outcome and advised Louise:
“I cannot thank you enough for all you have done for my family. Your very hard work and excellent negotiating skills were fully tested in achieving this tremendous result.
“Thank you from the bottom of my heart and, most importantly, thank you from my Dad who I know would have loved to have met you and would have been so made up to have a “good strong woman (his words) to fight for him.”
