Employee Awarded £45,000 in Work Accident Compensation

Jeff’s client was a 65-year-old Quantity Surveyor who was working on a fixed term contract for a well-known water utility provider.
Whilst on his lunch break he stepped outside from the canteen to access the smoking area. He then tripped over the threshold of the door and fell down two concrete steps, fracturing his right wrist.
Following the accident, which happened in June 2013, Jeff’s client was unable to return to work for several months and his employer terminated his contract.
Initially, he pursued a claim for compensation in person but, following a denial of liability, he contacted Slater and Gordon Lawyers in February 2014.
The issue in the case was whether the water utility company had taken reasonable care to ensure the client was reasonably safe while he was at work.
The fact that there was a two inch high threshold over which it was necessary to step in order to access the smoking area presented a reasonably foreseeable risk of someone tripping, particularly when they might be pre-occupied with carrying a cup of tea or coffee.
How Jeff helped:
Jeff reviewed the case and concluded that his client had a very good claim despite the denial of liability, and agreed to pursue the claim under a Conditional Fee Agreement (CFA), commonly known as a no win, no fee agreement.
Medical evidence was obtained and details of the client’s losses and expenses collated before proceedings were issued in May 2014.
The defendant utility company maintained their denial of liability and the case was listed for trial in July 2015.
Following the exchange of witness statements in March 2015, the defendant put forward proposals in settlement of the claim, which was eventually settled in the sum of £45,000.
