Nick's client was travelling in the back seat of a car being driven by his colleague who attempted an unsafe overtaking manoeuvre. This resulted in a glancing collision with an oncoming vehicle which caused the car to spin. Another vehicle then ploughed into the side of Nick's client's vehicle.
Nick's client bore the brunt of the collision impact and was seriously injured down his left side. He suffered multiple injuries, the most serious of which was a nerve injury in the pelvis area which left him permanently unable to bear weight through his left leg. Medical experts agreed that Nick's client is effectively wheelchair-bound and is still required to take morphine-based painkillers for ongoing, debilitating pain.
How Nick helped: An allegation of contributory negligence continued for some time after as Nick's client was not wearing a seatbelt at the time of the accident.
Experts specially commissioned by Nick confirmed however that wearing a seatbelt would not have made any difference to the injuries that Nick's client sustained and, in fact, could have made them even worse.
Nick obtained evidence from 15 different experts, including an expert immigration lawyer to persuade the defendant and the Court that his client's future losses should be calculated with reference to UK figures rather than those of his country of origin (Nick's client is from Nepal and does not yet have permanent UK residency).
Decision: The case was eventually settled, a few months before trial, at a joint settlement meeting with Nick securing £2,275,000 compensation for his client.
