Bin Man Receives Substantial Damages Following Crushing Injury
31 March 2015
Slater and Gordon Personal Injury Solicitor Matthew Thomlinson secured compensation for a bin man who suffered serious crush injuries.
Matthew’s client, Mr Alan Gray sustained serious injuries one day at work in April 2010. He was crushed by a bin descending from the right-hand side of a bin lorry when his ill-fitting high visibility vest was caught on the bin that was rising on the left-hand side of the lorry.
Mr Gray sustained multiple life threatening crush injuries including dislocation to the pelvis, a fracture dislocation to the left hip, de-gloving injury to the back and injury to his stomach which required extensive surgery and left him to develop a left foot drop and deep vein thrombosis as well as post-traumatic stress disorder.
Mr Gray’s employers disputed liability but Matthew obtained evidence from medical and engineering experts to help his client’s case. Matthew resolved Mr Gray’s compensation claim just two weeks before a three day trial at a round table settlement meeting.
In describing what the settlement meant for his client Matthew said, “I am pleased that we managed to resolve the claim through negotiations. The settlement will enable Mr Gray to fund the further treatment he requires. The case illustrates the dangers of workers operating close to very dangerous machinery and the fact that employers have to ensure that regular adequate training and refresher training is provided to all members of staff”.
Mr Gray himself added “I can’t thank Matthew enough. He was reassuring to me throughout the whole process and never once doubted me. I am delighted with the outcome which now provides financial security”.
