Pre-Nup ensures Ring-fencing of Financial Gift before Marriage

Slater and Gordon Family Solicitor Fiona Wood drew up a Pre-Nuptial Agreement for a lady whose fiancé had received a significant capital gift from his father.
Fiona's client and her fiancé agreed that this gift would be ring-fenced and therefore kept by him if they divorced. Fiona prepared a Pre-Nuptial Agreement for her client and ensured that these wishes were included.
Fiona also ensured that the Pre-Nup included details on how any matrimonial assets would be distributed on divorce. As Fiona's client and her fiancé were young and didn't have many assets between them, they agreed that all other assets including those that they will acquire during the marriage would be divided between them equally should their marriage break down and end in divorce.
Fiona's client and her fiancé intended to have a family so Fiona ensured that the Pre-Nuptial Agreement was silent on spousal maintenance and child maintenance.
Fiona's client will have hoped never to make use of the Pre-Nup but having it in place gave her peace of mind about what will happen should things not work out.
