Work Accident Claim Settled for £90,000 Compensation

Slater and Gordon Personal Injury Lawyer Damian Bradley secured £90,000 compensation for an engineer injured in work accident at Newcastle Railway Station.
Damian’s client sustained injuries in a work accident in January 2010. At the time of the accident he was re-lamping light fittings at Newcastle Railway Station and using a cherry picker to access the lamp approximately 10 metres high.
As a lamp was being unscrewed Damian’s client suffered a powerful electric shock believed to be in the region of 5000 volts.
The isolator switch had been used by Damian’s client but unbeknown to him it was faulty and the lamp was still live. The high voltage electric shock caused significant permanent muscle damage causing persistent lack of strength in the upper arms.
The strength of the convulsion from the electric shock ripped a tear in the client’s shoulder as he held the live lamp fitting.
Damian’s client was unable to carry on working as an electrical engineer because of the injuries sustained in his work accident. He was no longer fit for heavy work or prolonged working with his arms above head height and had to leave his job.
This was a difficult case, as at one time Court proceedings were issued against four different parties and no one was willing to accept blame for Damian’s client’s accident.
To add insult to injury the parties being sued tried to argue that it was Damian’s client who was at fault as he should have done a secondary test before touching the lamp rather than being entitled to rely on the isolator switch to function properly.
Just a week before trial, Damian successfully negotiated a settlement of his client’s work accident claim securing him £90,000 compensation.
Damian says that he is delighted that his client has won the hard fought battle against the four defendants adding that the level of compensation would have been much higher had his client, despite adversity, not been able to get himself back into paid employment.
Damian said that it is a testament to his client’s personality and drive that such was his desire to get back to a working life that he completely re-trained in a different field of work and by the time of the trial he had managed to secure a position as a train driver with similar earnings to his previous job.
