"I was instructed by the late Mr Duncan Sleeman very shortly before he died from the asbestos related cancer, Mesothelioma. He was very ill and unable to provide details about the circumstances of his exposure to the asbestos dust.
I carried out detailed investigations to trace his employment history and to establish where he was exposed to the asbestos dust which included making various enquiries to trace his former work mates.
Duncan originally came from Hayle in Cornwall and he previously worked for a company in the town called J & F Pool Ltd from 1965 -1981. I made various enquiries to trace some of his former colleagues, even contacting his former rugby club to see if they could help put us in touch with anybody.
I was eventually able to track down a number of gentlemen and met them to get detailed witness statements. These witnesses confirmed that as an apprentice, Duncan was involved in carrying out maintenance work on the factory floor of J & F Pool Ltd. In his later years he progressed and eventually became a senior production engineer.
However, as an apprentice he was involved in doing maintenance work on equipment and machinery in the factory and was exposed to asbestos dust when he stripped asbestos lagging and used asbestos materials such as lagging and gaskets.
J & F Pool Ltd were taken over by another company and refused to deal with our initial correspondence. I again carried out further investigations and traced the company’s former insurance company and as a result issued Court proceedings.
The company disputed their liability and obtained statements from former employees who were senior engineers which attempted to cast a doubt upon the evidence of Duncan’s former colleagues. The Mesothelioma compensation case was listed for trial in London in June 2014, but a compensation settlement agreement was reached after negotiations with the defendant in May for an undisclosed six figure amount of compensation.
