Business Property Seized by Unlawful Search Warrant Returned to Business Owner

30 October 2012

Slater and Gordon's Business Crime & Regulation Solicitors represented a successful businessman from whom property was seized pursuant to a search warrant obtained by Essex Police in relation to a joint investigation by the Child Support Agency and HM Revenue & Customs.

Having reviewed the search warrant Slater and Gordon Lawyers immediately submitted detailed written representations to the agencies concerned, making it clear that the search warrant had been unlawfully obtained in that there had been a material non-disclosure in the information given to the Court when applying for the warrant.

In consequence of those representations all material seized from the property was returned forthwith it having been conceded that there was no necessity for us to have obtained a Court order compelling its return.
