Tom Nutter successfully defended a police officer over a death by careless driving allegation

Tom Nutter, a Senior Solicitor in the Wakefield Criminal & Misconduct department, successfully defended a South Yorkshire police officer over death by dangerous driving allegations. The police officer was responding to a priority call in the early hours of the morning. He accelerated to approx 50 mph in order to reach the incident faster however he did not have any emergency warning equipment illuminated. A student ran into the road, hit the police car and was sadly killed instantly. The experts agreed that the speed in itself was not careless and so the matter was left to the jury on the basis of the failure to use any emergency warning equipment. The police officer was acquitted of all charges and found not guilty by the jury.
